1) Definitions.

"Online Sales Contract" means the purchase and sale contract concerning the Supplier's products concluded between the Supplier and the Customer within the framework of a distance selling system through telematic means, organized by the Supplier (hereinafter the "Contract").

  • "Customer": is the consumer natural person who makes the purchase and accepts the general conditions of sale;

  • "Supplier": is the entity that performs the sale of the goods covered by this Contract (Spezia Calcio Online Store);

  • "Order": is the request form of the goods for sale, filled by the Customer through the Site.

  • "Products": are the goods offered for sale on the Site, according to the general conditions of sale;

  • "Price": is the consideration for the sale of the goods;

  • "Contract": is the distance contract that has as its object the sale of the products, according to the General Conditions of Sale.

 

2) Parties to the Contract and access to the service for the purchase of Products

The "Customer" expressly declares that he/she is making the purchase for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. Access to the online purchasing service of the Products is allowed by means of a customer identification code and a keyword (hereinafter "Password") and it is expressly forbidden for the Customer to enter false and/or fictitious data in the registration procedure necessary to activate the process of execution of this Contract and the related further communications. Spezia Calcio Online Store reserves the right to prosecute any violation and abuse in the interest and for the protection of consumers and disclaims to the Customer any liability arising from the issuance of incorrect tax documents due to errors related to the data provided by the Customer, being the Customer himself solely responsible for the correct entry.

 

3) Object and conclusion of the Contract

By this Contract, the Supplier sells to the Customer, who purchases at a distance, through telematic means, exclusively the Products indicated and offered for sale on the website store.speziacalcio.com (hereinafter "Website"). The Contract between the Supplier and the Customer is concluded exclusively through the Internet network by means of the Customer's access to the address of this Website, where, following the procedures indicated in the appropriate registration section, the Customer will subsequently arrive to formalize the proposal for the purchase of the Products offered for sale through the Website. In order to proceed with a purchase the Customer, must follow the following steps:

  • select the product and operate the "add to cart" button, after which a summary of the main characteristics of the chosen product and an indication of the total price due, including shipping costs (excluding only any customs duties, where due) and taxes may be consulted;

  • operate the "check-out" button and fill out the request form ("Order") indicating the chosen payment method (the Customer, before proceeding to the next step, is required to verify the accuracy of all the data entered, for the correspondence of which he is responsible);

  • view these general terms and conditions by clicking on the relevant button and express acceptance of them by clicking on the box next to the words "I accept the terms and conditions of sale".


When the Supplier receives the purchase order from the Customer, it will send a confirmation e-mail and/or display a printable web page confirming and summarizing the purchase order, in which the data entered by the Customer in the order form will be shown.

In case of need for an invoice, the customer may request it by contacting Customer Service at the email address store@speziacalcio.com immediately after making their purchase.

 

4) Payment and Refund Methods.

Spezia Calcio Online Store of Spezia Calcio Srl accepts payment for Products purchased by means of Shopify Payments. Credit card information is handled directly by credit institutions and/or financial companies, which specialize in handling online payments. The information is encrypted through the use of encryption systems that prevent its use by third parties and is sent directly to the bank. In case of any irregularity in the payment transactions Spezia Calcio Online Store reserves the right, as a result of specific checks (for example: verification of the ownership of the credit card, control about unauthorized or abusive use of the credit card), not to follow up on the order. If the conditions are met, any refund to the Customer will be made by reversal of the credit card payment, within 14 days from the date on which Spezia Calcio Online Store became aware of the cause that generates the right to reimbursement.

 

5) Time and method of delivery of the Products

Spezia Calcio Online Store will deliver the Products ordered through agreed Couriers (GLS for domestic shipments, GLS / DHL for international shipments). Order fulfillment times may vary, from 2 to a maximum of 10 working days from the execution of the order and receipt of payment for the goods. In the event that Spezia Calcio Online Store is not able to make the shipment of the Products ordered within that period will be given timely notice by e-mail and / or telephone communication to the Customer, indicating the deadline by which the order will be followed. It is understood that delivery times may vary depending on the country of destination and other factors that do not however depend on the will of Spezia Calcio Online Store. For international shipments, the cost of shipping depends on the country of destination and the weight/volume of the package. The customer will be able to view the cost online at the end of the order, before confirming it.

 

6) Shipping and delivery costs of the Products

Spezia Calcio Online Store ships using the DDP (Delivery Duty Paid) formula in the EU countries, therefore in these destinations the Products ordered will arrive directly at the place of delivery indicated by the Customer without the Customer having to pay any additional amount over and above what has already been paid at the time the order was formulated. For all other countries the DDU (Delivery Duty Unpaid) formula is used, therefore the courier may present the Customer with a separate invoice at the time of delivery of the Products requesting payment of duties and taxes required by local authorities.

 

7) Liability arising from transportation

The Supplier shall not be liable for any delay in processing the order or delivery of products due to the carrier and any damage caused to the goods during transport. Spezia Calcio Online Store will provide to the carrier goods perfectly intact and corresponding to the order requested. Upon delivery of the Products by the carrier, the Customer is required to check:

  • that the Product or the packaging is perfectly intact and not damaged or altered;
  • that the number of Products delivered corresponds to what is indicated in the order confirmation;


In case of any anomaly found, the Customer must not accept the goods and must raise the objection directly to the carrier, stating specifically what discrepancies he found. In the absence of such a statement, the Customer may not raise further objections about the existence of obvious defects in the delivered Products.

 

8) Prices of the Products.

All sales prices of the Products displayed and indicated are in euros (€) and include VAT and any other taxes for what concerns delivery within the territories of an EU country. For deliveries to countries outside the EU, as specified in point 6), the courier may require additional amounts from the Customer for local taxes and duties. The shipping costs will be indicated and calculated in the procedure of purchasing the Products prior to the placing of the order by the Customer and also contained in the summary web page of the order placed. It is understood that the prices of the Products may be varied unilaterally and at any time by Supplier, it being understood that the price of the Product indicated in the web page of summary of the order placed by the Customer shall be binding between Supplier and Customer.

 

9) Limitation of Supplier's Liability.

Spezia Calcio Online Store assumes no liability for any fraudulent and illegal use that may be made by third parties, of the credit cards used for the payment of the Products purchased, if it proves that it has taken all the ordinary precautions possible at the time and according to ordinary diligence. It is specified that Spezia Calcio Online Store will not provide refunds for customized products.

 

10) Product defect liability, proof of damage and compensable damages

Spezia Calcio Online Store shall not be held liable for any direct and/or indirect, contractual and/or extra-contractual damage suffered by the Customer arising from defects and/or faults in the Product if the defect and/or fault is due to the conformity of the Product, to a mandatory legal norm or binding measure, or if the state of scientific and technical knowledge at the time when the manufacturer placed the Product on the market, did not yet allow the Product to be considered as defective and/or flawed. It is understood that no compensation shall be due if the Customer was aware of the defect and/or defect in the Product and the danger arising therefrom and nevertheless voluntarily exposed himself to it. In any case, the Customer has the burden of proving the defect and/or vice of the Product purchased, the damage and the causal connection between the defect and the damage suffered. The Customer is aware that the Products ordered are described and photo-reproduced on the Web Site, therefore, he/she will tolerate the normal differences and distortions in the color of the Products delivered to him/her compared to the Products viewed on the Web Site.

 

11) Guarantees and Methods of Assistance in favor of the Customer.

The Vendor shall be liable for any ascertained defect and/or vice of the Product, always if attributable to the same, provided that such defect and/or vice has been reported by registered letter A.R. to Spezia Calcio srl, Via Melara, 91 - 19136 La Spezia or sent by e-mail to store@speziacalcio.com within the term of eight days from the delivery of the Product. The complaint is not necessary if the Vendor has acknowledged the existence of the defect and/or defect or has concealed it. The Vendor reserves the right to request photographic reproductions of the allegedly defective and/or flawed Products from the Customer before authorizing returns and/or exchanges. In the event that the Products are defective and/or flawed, the Supplier will bear the transportation costs necessary to return the Products to its warehouses. Exchanges or returns of Products that have been tampered with, worn, washed or otherwise altered by the Customer will not be accepted. It will be the Customer's responsibility to arrange for the transportation of goods returned for exchange to the Supplier. In case of theft or loss of the returned Products, which occurred during transportation to the Supplier, the goods will not be refunded. It is understood that returns of custom-made or personalized Products will not be accepted. In the event that a defect is found in the Product purchased, the Customer may make use of the "Customer Service" service through the use of a telephone number and e-mail address specifically dedicated to this service, indicated on the Website.

 

12) Obligations of the Customer

Having completed the online purchase procedure, the Customer undertakes to arrange for the printing and storage of these general conditions of sale as well as the specifications of the Product being purchased. The Customer agrees to pay the price of the Product purchased in the time and manner specified in the Contract.

 

13) Right of Withdrawal

The Customer has the right to withdraw from the Contract, pursuant to Legislative Decree 21/02/2014 n. 21 within the term of 14 (fourteen) days, starting from the day of sending the purchase order for the Products. In the event that the Customer avails himself of the right of withdrawal, he must notify the Supplier by email at store@speziacalcio.com. In any case, the Customer to make use of the right to a refund of the price of the Product, must return the Product intact in its packaging with labels and, in any case, not used or worn. The Customer acknowledges that the right of withdrawal cannot be exercised in relation to Products ordered by the Customer that have been personalized (e.g. personalization of a game jersey with name and number). The only costs payable by the Buyer for the exercise of the right of withdrawal, in accordance with this article, are the costs of transporting the Product to Spezia Calcio Online Store. Products that are not returned in the above manner will not be accepted by the Supplier and, as a result, will not be refunded. It is understood that in case of the right of withdrawal, the Supplier shall not be liable for the theft or loss of the Products that occurred during the transportation of the goods to the Supplier. In case of exercise of the right of withdrawal by the Customer, the Supplier will refund the price of the Product, within the period of 14 days from the receipt of the notice of withdrawal provided that within this period the goods have been returned in the condition and manner specified in this article. 14) Exchange of Products

In compliance with current regulations regarding the containment of the spread of the Covid-19 virus, please be advised that, at this time, the return and exchange of purchased Products is not permitted for reasons related to the size and/or color and/or model of the Products.

 

15) Protection of Confidentiality and Personal Data of the Customer

Spezia Calcio Online Store protects the privacy of its Customers and guarantees that the processing of data is performed in accordance with the provisions of the privacy legislation. The Customer is informed of the different types of consent to the use of his personal data, which he may give on a voluntary basis and in a revocable manner at all times. Spezia Calcio Online Store informs the Customer that every order sent is stored in digital form on the server hosting the Website according to criteria of confidentiality and security.

17) Jurisdiction and Applicable Law.

For any dispute relating to the interpretation, execution or termination of this agreement, the Court of La Spezia shall have exclusive jurisdiction.



18) Effectiveness of the Contract

The confirmation of the purchase order of the Products implies for the Customer the acceptance of these general conditions of contract. These general conditions of contract may be updated and/or modified unilaterally by the Supplier and will be valid from the date of publication on the Website.
